REFLECŢII ASUPRA UNOR TERMENI FOLOSIŢI ÎN PROCESUL PENAL
The author analyses the terminology used in the criminal trial for the criminal, against whom a trial is started and carried out.
The analysis is related to a literal interpretation, to the previous criminal trial legislation, to other countries’ legislative models and to community rules in terms.
In terms of what is mentioned above, a reassessment of this terminology is required, especially the replacement of the term “suspect” from the new Code of Criminal Procedure, which does not really reflect the legal status of the person referred to.
