Circumstanţele agravante judiciare

Aggravating circumstances are judicial states, situations, circumstances,
objective realities that the court cannot ignore, when they exist, but, although
aware of them, the court is not forced to recognize their aggravating feature.
This recognition is optional only when the aggravating circumstance integrates
in the complex of all the other elements and is considered by the court to have
an important weight in characterizing the offence and the personality of the
offender.
